1. Acceptance of Terms

By downloading, installing, accessing, or using the 3AM Notes application, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions stated herein, you must refrain from using the application and uninstall it immediately.

2. User Responsibilities and Content

3AM Notes is a private journaling application. You assume full responsibility for any and all content you create, record, attach, or store within the application. You agree not to utilize the application for any unlawful, infringing, or malicious purposes.

3. Local Storage and Data Loss

The 3AM Notes application employs a local-first architecture. We do not store your data on our servers. Consequently, we are unable to recover your data if your device is lost, damaged, or if the application is uninstalled without a prior backup. It is your sole responsibility to implement appropriate data backups using the application's export features or your device's system-level backup utilities.

4. Pro Subscriptions and Billing

Access to certain advanced features is available through a "Pro" subscription. All subscriptions, billing processes, and renewals are managed exclusively by the respective app distribution platform (Apple App Store or Google Play Store). To manage or cancel a subscription, you must use your device's subscription settings. Any refund requests are subject to the policies of the respective app store, as we do not process transactions or refunds directly.

5. Intellectual Property Rights

The design, source code, branding, and all underlying intellectual property rights associated with the 3AM Notes application are the exclusive property of its developers. By utilizing the application, you retain full ownership and rights exclusively to the personal content you generate within the app.

6. Disclaimer of Warranties

The 3AM Notes application is provided on an "as-is" and "as-available" basis, without representations or warranties of any kind, whether express or implied. We do not warrant that the application will function uninterrupted, be completely error-free, or meet your specific requirements.

7. Limitation of Liability

To the maximum extent permitted by applicable law, the developers of 3AM Notes shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, arising out of or related to your use of, or inability to use, the application.

8. Modifications to Terms

We reserve the right to revise or update these Terms of Service at our discretion. Your continued use of the application following the posting of modifications will constitute your acceptance of the revised terms.
